Rules and Policies

Action Arts emphasizes Safety, Responsibility and Respect in the gym. We ask participants (and their guardians) to indicate their understanding by reviewing and signing this form below.

SAFETY
Participants are expected to keep themselves and others safe by following instructions of coaches and staff at Action Arts. Actions and behaviors that endanger others are not permitted. Any form of harassment, bullying, disrespect, verbal or physical violence is not permitted and will not be tolerated. If there are any problems with participants, we will speak with the responsible adult and attempt to remedy the situation first. If a remedy cannot be reached, we reserve the right to drop the participant from the program.
ANY PARTICIPANT BEHAVING IN A MANNER THAT IS DEEMED DANGEROUS BY AN ACTION ARTS COACH AND/OR STAFF, WHETHER INTENTIONAL OR UNINTENTIONAL, WILL BE DISMISSED FROM THE PROGRAM. 


Makeup Policy
We offer 1 make up for a missed class per month. To keep our student to teacher ratios, the make up class must be enrolled in, and be with the same coach as the missed class.
Missed classes and gym closures will NOT result in prorated tuition or refunds. 


Drop/Cancellation Procedure
Parents must notify Action Arts to drop a student from class NO LESS THAN 15 DAYS BEFORE THE START OF THE NEXT MONTH. Only a written notice via email, postal mail, requested through the class portal, or hand delivered to our front desk will be acceptable.

You are responsible for payment for your student's classes WHETHER OR NOT YOUR STUDENT ATTENDS CLASS until the time you notify the staff via written notice. If a student stops coming to class without notification, that student's account will continue to be charged each month. This charge will be for holding the student's place in that class instead of offering that place to one of the many on a waiting list. In order to hold a student's place, we will NOT dis-enroll students based on attendance. Action Arts does not backdate drop/cancellation notices.


What To Wear & What Not To Wear Policy
Participants should wear athletic attire, T-shirts and shorts, leggings or sweatpants WITHOUT pockets or metal buttons.
NO chewing gum, dangling jewelry or large hair ornaments.
Hair should be pulled neatly and securely away from the face so that is stays up for the entire workout.
All students should remove footwear and socks before entering the gym floor. Socks with good grips can be worn IF the teacher approves them.
Personal items should be left on cubby shelves. Please leave valuables at home. This facility's staff will not be responsible for ANY items that may be lost or stolen. We recommend your student's personal items are marked with their name.

 

Arrival & Pickup
Be sure your student arrives 5 minutes before their scheduled class time. Please pick up your student on time and inform us if you know you will be late picking up your student. Instruct your student to wait inside the building and you should escort them from the building to your car. Do not take a chance on your student running to and from your car.
Please consider parking in a further parking spot or on Meeker Street if you have older children. 

Release, Waiver of Liability, Assumption of Risk

ACTION ARTS INC. RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK IN CONSIDERATION of being permitted to utilize the services and programs of ACTION ARTS, INC. (“Action Arts”) and enter into its premises and facilities for any purpose, including but not limited to use of its facilities and equipment, participation in any program offered by or affiliated with Action Arts which may or may not involve inherently dangerous activities, or observation of the same while on its premises (“Permitted Uses”), the undersigned (“Releasor”), for himself/herself/themself, his/her/their spouse, legal representatives, heirs, assigns, and the minor or minors listed below for which Releasor is a parent or guardian (“the Minor(s)”), hereby agrees to the following:

1. Release, Waiver of Liability. Releasor releases, waives and discharges Action Arts, Action Arts’ franchisees, the owner of the premises, the landlord, mortgagees, management company of the premises, and any of their lenders, parents, affiliates, subsidiaries, officers, directors, shareholders, members, managers, partners, agents, employees, contractors, representatives, heirs, assigns, volunteers, independent contractors, equipment suppliers, and insurers of all the preceding parties (collectively, “Releasees”) from all liability to Releasor, his/her/their spouse, legal representatives, heirs and assigns, for any and all loss or damage, and any claim for damages resulting from the same, on account of any injury to Releasor’s or the Minor(s)’ person or property, including injury resulting in death of the same, whether caused by the negligence of Releasees or otherwise, while Releasor is engaged in the Permitted Uses or as a consequence of any care rendered under Para. 5 below.

2. Warranties and Representations. Releasor hereby acknowledges, agrees, warrants and represents that he/she/they and the Minor(s) are in good physical health and are able to participate safely in the Permitted Uses. Releasor further warrants that entry into the premises and facilities of Action Arts constitutes an acknowledgement that such premises and all facilities and equipment therein and any affiliated program or event are safe and reasonably suited for the purpose of engaging in the Permitted Uses by Releasor and the Minor(s).

3. Indemnification. Releasor agrees to indemnify Releasees, collectively and individually, from any loss, liability, damage or cost Releasees may incur from Releasor’s or the Minor(s)’ engagement in the Permitted Uses or from any care rendered under Para. 5 below, whether caused by the negligence of Releasees or otherwise.

4. Assumption of Risk. RELEASOR ACKNOWLEDGES THAT THE PERMITTED USES MAY INVOLVE POTENTIALLY DANGEROUS ACTIVITIES, AND THAT EVEN IF RELEASEES USE REASONABLE CARE IN PROVIDING THESE ACTIVITIES, THERE IS A CHANCE THAT RELEASOR AND/OR THE MINOR(S) MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. RELEASOR ASSUMES FULL RESPONSIBILITY ON BEHALF OF HIMSELF/HERSELF/THEMSELF AND THE MINOR(S) FOR THE RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE WHILE PARTICIPATING IN THE PERMITTED USES.

5. Medical Care. Releasor hereby grants permission for Action Arts’ staff or their agents to administer First Aid, CPR or AED to him/her/them or the Minor(s) in the event of an emergency. In the event Releasor cannot be reached, or if Releasor is unresponsive due to a medical emergency, Releasor authorizes Action Arts to seek medical care for Releasor or for the Minor(s) and hereby grants permission to the attending physician to order X-rays, routine tests and provide any other medically appropriate treatment.

6. Media Release. From time to time, Action Arts may take photographs or create audio or video recordings (“Content”) of its clients while they are engaged in the Permitted Uses.
Releasor grants Action Arts the right to use the Content, and the likenesses of Releasor and the Minor(s) in Action Arts’ advertising and media materials, without an additional release or authorization. Releasor assigns to Action Arts all intellectual property rights to the Content, and hereby waives the right to enforce against Releasees any right of publicity, privacy, intellectual property, or claims of any kind related to the Content.

7. Choice of Law; Severability. Releasor expressly agrees that all the foregoing terms, including but not limited to the release, waiver, warranties and representations, and indemnification contained herein, are intended to be as broad and inclusive as is permitted by the laws of the State of California, and that if any portion thereof is held invalid, agrees that the balance shall, notwithstanding, continue in full legal force and effect.

8. Entire Agreement. Releasor acknowledges having read and voluntarily agreeing to all the foregoing terms and further agrees that no oral representations, statements or inducement apart from the foregoing written agreement have been made.    
BY SIGNING THIS FORM YOU UNDERSTAND THAT YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM RELEASEES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOU OR YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE PERMITTED USES. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND ACTION ARTS HAS THE RIGHT TO REFUSE TO LET YOU OR THE MINOR(S) PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

Billing Authorization

I represent and warrant that if I am purchasing something or paying for a service from Action Arts Inc, that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.

I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I UNDERSTAND THAT A WRITTEN NOTICE IS REQUIRED NO LESS THAN 15 DAYS BEFORE THE START OF THE NEXT MONTH TO TERMINATE BILLING. Action Arts does not backdate drop/cancellation notices.

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.

I AM RESPONSIBLE FOR PAYMENT MY STUDENT'S CLASSES WHETHER OR NOT MY STUDENT ATTENDS CLASS until the time I notify the staff VIA WRITTEN NOTICE.
